شروط الخدمة

هذه الوثيقة متاحة باللغة الإنجليزية.

Effective date: {{EFFECTIVE_DATE}}
Operator: {{OPERATOR_NAME}}, {{OPERATOR_ADDRESS}}, {{OPERATOR_COUNTRY}}
Website: {{WEBSITE}}

In short

My Mosque helps mosques run their finances, members, meetings, prayer times and announcements. By using it you agree to these terms. Your mosque decides what information it collects and is responsible for using it lawfully; we run the service on the mosque's behalf. We do not build My Mosque to make a profit: fees only cover the cost of running it. You can stop at any time. We do our best to keep the service safe and working, but we cannot promise it will never fail, and our liability is limited as far as the law allows.

1. Who we are and what these terms cover

These terms are an agreement between you and {{OPERATOR_NAME}} ("we", "us"). They cover the My Mosque apps for Android, iOS, web and Windows, the website {{WEBSITE}}, and our support (together, "the Service").

Other documents form part of these terms:

  • Subscription Terms: plans, prices and billing.
  • Acceptable Use Policy: what you may and may not do.
  • Privacy Policy: how we handle personal data.
  • Data Processing Addendum: our data agreement with each mosque.

If these documents conflict, the Data Processing Addendum wins on data protection, the Subscription Terms win on billing, and these terms win on everything else.

2. Accepting these terms

You accept these terms when you create an account, join a mosque, or use the Service. If you use the Service for a mosque, a group of mosques or another organisation, you confirm you are allowed to accept these terms for it. In that case "you" also means that organisation.

If you do not agree, please do not use the Service.

3. Who may use My Mosque

  • Organisations: mosques, Islamic centres, trusts, charities, associations and groups of mosques.
  • Adults: people aged 18 or over (or the age of adulthood where they live, if higher) may create their own account.
  • Young people under 16: may use the Service only through their mosque, and only with the consent of a parent or guardian. The mosque is responsible for getting and recording that consent. Some countries set a different age (for example 13 in the US, 14 in South Korea, 18 in India). Where local law sets a higher age, that age applies.
  • You may not use the Service if the law where you live forbids it, or if we have closed your account for breaking these terms.

4. Your account and its security

  • Sign in with your email and password, or with Google.
  • Keep your password secret. Do not share accounts. Each person should have their own.
  • People who run a mosque must set a four-digit app passcode. It stays on your device and is never sent to us. We cannot see it or recover it; you can reset it with your account password.
  • Tell us at once at {{SUPPORT_EMAIL}} if you think someone else has used your account.
  • You are responsible for what happens under your account, unless it happened because of our fault.

5. The roles of your mosque and of us

Your mosque is in charge of its own data. The mosque's officers decide what details to ask members for, which papers to collect, who sees what, and how long to keep records. In data protection terms, the mosque is the controller of its members' data.

We run the Service on the mosque's behalf. We store and process that data only to provide the Service, following the mosque's settings. In data protection terms, we are the mosque's processor.

We are in charge of a small amount of data ourselves. For your account (email, sign-in), support tickets and billing contacts, we are the controller. Our Privacy Policy explains this.

6. The mosque's responsibilities

If you run a mosque on My Mosque, you (the mosque) agree to:

  1. Collect data lawfully. Only ask for what you need. Have a lawful reason for each detail, and tell members why you collect it (for example in your own privacy notice).
  2. Get proper consent where needed. This includes Gift Aid declarations, SEPA direct debit mandates, copies of ID cards, passports or driving licences, photos, and anything about children.
  3. Respect special-category data. Being a member of a mosque can reveal a person's religion. Handle it with care and make sure you have a lawful basis (see the Privacy Policy, section 6).
  4. Keep accurate finance records. You are responsible for what is entered: donations, zakat, expenses, payroll and bank reconciliation. My Mosque is a record-keeping tool. It does not check that your accounts are complete or correct.
  5. Follow your own laws. This includes charity law, tax law (for example Gift Aid rules in the UK), employment and payroll law, anti-money-laundering rules, and data protection law where you are.
  6. Choose officers carefully. Give roles only to trusted people. Remove access when someone leaves a role.
  7. Answer your members' data requests. When a member asks to see, correct or delete their data, the mosque decides and responds. We will help (see the Data Processing Addendum).

7. Acceptable use

In short: use My Mosque lawfully and respectfully. Do not use it for hate, extremism, harassment, fraud, money laundering or terror financing. Do not scrape it, attack it, or copy its code. The full rules are in the Acceptable Use Policy.

8. Plans and billing (summary)

  • Free for life ("Small"): up to 3 admins and 50 members. A person can be an admin of only one free mosque.
  • Standard: up to 5 admins and 150 members, $25/month or $280/year.
  • Large: up to 50 admins and 2,000 members, $600/month or $7,000/year, with a 60-day free trial.
  • Add-on packs for Standard and Large: +3 admins or +20 members, each $10/month or $110/year.
  • Prices are in US dollars, per single mosque or organisation. Taxes may apply.
  • Paid plans are bought on {{WEBSITE}} through Stripe, renew automatically, and can be cancelled at any time (effective at the end of the paid period).
  • If a plan ends or a payment fails, nothing is deleted. You can still read and edit your data.

The full rules are in the Subscription Terms.

9. We are not here to make a profit

We do not build My Mosque to make money from mosques. We built it to serve them. A mosque's data lives in the cloud so it is safe, backed up and shared across the committee's phones, and cloud services cost money. Subscription fees only cover servers, the cloud database and storage, maintenance and support. Small mosques can use My Mosque free for life.

10. Our intellectual property

My Mosque is closed-source software. We (or our licensors) own the apps, the website, the code, the design and the name "My Mosque". We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service under these terms. You may not copy, sell, rent, modify, reverse engineer or decompile it, except where the law expressly allows this.

Quran text, translations and audio used in the app come from third-party sources. They are credited inside the app and remain the property of their owners. CHECK: confirm the licence for each source.

11. Your content

"Your content" means everything you or your mosque put into the Service: member details, finance records, documents, photos, minutes, announcements and so on.

  • You keep ownership of your content. The mosque owns its records.
  • You give us a limited licence to store, copy, process, display and transmit your content only as needed to run, secure, back up and support the Service for you. This licence ends when your content is deleted, except for copies in backups that are deleted on their normal cycle.
  • We do not use your content for advertising, we do not sell it, and we do not share it with anyone except the service providers listed in the Privacy Policy.
  • You promise you have the right to upload your content, and that it does not break the law or anyone's rights.

12. Feedback

If you send us ideas or suggestions, we may use them freely to improve the Service, without paying you. We will not name you without your permission.

13. Availability and maintenance

  • We aim to keep the Service running at all times, but we do not promise it will always be available or free of errors.
  • The apps work offline and sync when you are back online. Data not yet synced lives only on your device until it syncs.
  • We may need to pause the Service for maintenance or updates. We will try to give notice for planned work and to do it at quiet times.
  • We may change or remove features. If we remove a major feature you pay for, we will tell you in advance, and you may cancel.
  • Please keep your apps updated. Old versions may stop syncing.

14. Ending the agreement

You can stop using the Service at any time. You can delete your account in the app or on {{WEBSITE}}. A mosque can cancel its plan at any time (see the Subscription Terms).

We may suspend or close an account or a mosque if:

  • it seriously or repeatedly breaks these terms or the Acceptable Use Policy;
  • the law requires us to; or
  • it puts the Service, other users or us at risk.

Where it is safe and lawful, we will warn you first and give you a chance to fix the problem. If we close a mosque's space, we will give its officers a reasonable chance to export their records, unless the law forbids it.

What happens to data: see "Deleting your account" in the Privacy Policy. Financial records a mosque must keep by law stay with the mosque, removed from the person's name where possible.

Sections 10, 11 (ownership), 15, 16, 17, 18 and 19 continue after the agreement ends.

15. Disclaimers

  • Record-keeping, not advice. Finance, payroll, Gift Aid, zakat and report features are tools for keeping records. They are not accounting, tax, legal or religious advice. Check important matters with a qualified person.
  • Prayer times are calculations. They are worked out on your phone from a calculation method and the mosque's settings. They may differ from your mosque's announced times. Always check with your mosque.
  • The mosque's content is the mosque's. We do not check what mosques or members write. We are not responsible for it.
  • Apart from what these terms say, the Service is provided "as is" and "as available". As far as the law allows, we give no other promises, for example that the Service fits a particular purpose. Nothing here removes rights you have by law as a consumer.

16. Limitation of liability

  1. We are not liable for loss you could not have foreseen, for indirect loss, or for loss of profits, revenue, donations or goodwill.
  2. We are not liable for loss caused by events outside our reasonable control, by your mosque's own decisions or entries, or by you not keeping your password safe.
  3. Our total liability to an organisation for all claims in any 12 months is limited to the greater of (a) the fees it paid us in those 12 months or (b) US $100.
  4. Nothing in these terms limits liability that cannot legally be limited. This includes liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct where the law says so, and your rights as a consumer under mandatory law (for example in the EU, UK, Australia or Germany). In Germany, we are liable without limit for intent and gross negligence, and for slight negligence only for breach of essential contractual duties, limited to foreseeable typical damage.

17. Indemnity (organisations only)

If you use the Service as an organisation, you agree to cover our reasonable losses and costs (including legal fees) from claims by others that arise because you broke these terms or the law, or because of content you uploaded or data you collected without a lawful basis. We will tell you promptly about such a claim and let you help with the defence. This section does not apply to consumers.

18. Governing law and disputes

These terms are governed by the laws of {{GOVERNING_LAW}}. Courts there will deal with disputes.

But: if you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts. EU consumers may also use their national consumer dispute bodies.

Before going to court, please contact us at {{SUPPORT_EMAIL}}. Most problems can be solved by talking.

19. General

  • If one part of these terms is found invalid, the rest still applies.
  • If we do not enforce a right straight away, we still keep it.
  • You may not transfer these terms to someone else without our consent. We may transfer them to an organisation that takes over the Service, if your rights are not reduced. We will tell you.
  • These terms are the whole agreement between us about the Service.

20. Changes to these terms

We may update these terms. If a change is important, we will tell you in the app or by email at least 30 days before it takes effect. If you do not agree, you can stop using the Service and cancel before the change takes effect. Small changes (for example fixing typos or clarifying wording) may take effect at once.

21. App store users

21.1 Apple App Store (iOS and iPadOS)

If you downloaded My Mosque from Apple's App Store, these extra terms apply. They follow Apple's minimum requirements for app licences.

  1. Agreement is with us, not Apple. These terms are between you and {{OPERATOR_NAME}} only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
  2. Scope of licence. Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. Family Sharing and other uses those rules allow also apply.
  3. Maintenance and support. We alone are responsible for maintenance and support of the app, as described in these terms or as required by law. Apple has no obligation at all to provide maintenance or support for the app.
  4. Warranty. We alone are responsible for any product warranties, whether given in these terms or implied by law, to the extent not effectively disclaimed. If the app fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price of the app to you (if any). To the maximum extent allowed by law, Apple has no other warranty obligation about the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, not Apple's.
  5. Product claims. We, not Apple, are responsible for dealing with any claims by you or any third party about the app or your use of it. This includes (a) product liability claims; (b) claims that the app fails to meet any legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws, including in connection with the app's use of HealthKit and HomeKit frameworks (My Mosque does not use these).
  6. Intellectual property claims. If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  7. Legal compliance. You confirm that (a) you are not located in a country that is subject to a US Government embargo, or that the US Government has designated as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints or claims about the app: {{OPERATOR_NAME}}, {{OPERATOR_ADDRESS}}, {{SUPPORT_EMAIL}}.
  9. Third-party terms. You must follow any third-party terms that apply when using the app (for example your mobile carrier's terms).
  10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

CHECK: Paid plans are bought on {{WEBSITE}}, not through Apple in-app purchase. Confirm with Apple's App Review Guidelines (section 3.1, for example 3.1.3 on services sold to organisations) how the iOS app may refer to the website, before submitting.

21.2 Google Play (Android)

If you downloaded My Mosque from Google Play, Google's Play Terms of Service also apply to your use of Google Play. These terms are between you and us, not Google. Google is not responsible for the app or its support. Paid plans are bought on {{WEBSITE}}, not through Google Play billing. CHECK: confirm this is allowed under Google Play's Payments policy for this app, and how the app may mention the website.

21.3 Microsoft Store (Windows)

If you downloaded the Windows app from the Microsoft Store, Microsoft's Store terms also apply to the Store. These terms are between you and us, not Microsoft.
